【内容提要】自2003年实施社区矫正以来，我国社区矫正人员服刑期间的再犯罪率常年保持在0.2%的极低水平。本研究通过对北京市东苑 司法所社区矫正过程的参与式观察和矫正工作者访谈材料的分析，揭示了社区矫正预防犯罪的核心逻辑，即风险控制与情感治理。一方面，社区矫正工作者对服刑人员进行周期性检视，识别其日常生活情境中的再犯罪风险并进行干预；另一方面，针对“在社区服刑”衍生的污名和社会排斥，社区矫正工作者通过情感传递、情感重塑、情感联结三种路径调和社区服刑人员遭遇的结构性困境，有效降低了再犯罪风险。随着《中华人民共和国社区矫正法》的正式施行，在刑罚制度化和规范化过程中，既要以刚性的风险控制作为保障，也要重视矫正过程中的情感维度，从而实现国家犯罪治理和个体再社会化的双重功能。

Risk Control and Emotional Governance:The Practical Logic and Implement Strategies in Chinese Grass-Roots Community Correction

Abstract：It is worth noting that the recidivism rate of offenders in China has been maintained at a very low level of 0.2% year-round since the implementation of community correction in 2003. Through participant observation in a judicial office in Beijing and content analysis of official documents, the current study reveals the crime prevention mechanism of community correction at the micro level. Under the logic of risk control, on the one hand, community correction officers conduct periodic examinations of offenders to identify and intervene in the risk of recidivism in their daily life. On the other hand, in response to the risk factors that result from community sentences, such as stigma and social exclusion, community correction officers reconcile the structural tensions through emotional practices in three dimensions: emotional transmission, emotional reconstruction and emotional connection, which in turn effectively reduce the risk of recidivism. With the implementation of the Community Correction Law of the People’s Republic of China, this study argues that in the process of institutionalization and normalization of punishment, it is necessary to guarantee rigid risk control as well as to pay attention to the emotional dimension of the correctional process, so as to achieve the dual functions of crime governance and re-socialization of individuals.
